Terms and Conditions of Business

Scope

These General Terms and Conditions of Business govern the provisions of contract for all legal transactions between customers or users (hereinafter called the “Seller”) of the Internet portal www.royalgoldbuyers.co.uk and KJ noble metals (hereinafter called “Goldbuyer Joseph”, Suite 2, 186 St Albans rd, Watford, London, WD24 4AS
United Kingdom (Germany: Trierer Street 12, 99423 Weimar Austria: Vienna Stock Exchange: Schottenring 16, 1010 Vienna). Provisions of the Seller deviating from these will remain ineffective until Goldbuyer Joseph has expressly agreed to their validity in writing. In order to conclude a contractual agreement, the Seller must have unrestricted legal capacity and have reached the age of consent.

Transit/ Delivery

The transit or delivery of any kind of precious metals, jewellery or other valuables by the Seller to Goldbuyer Joseph is effected solely at the risk and cost of the Seller. Goldbuyer Joseph recommends the Seller to send the items by post and to insure them to an adequate extent according to their value. In addition, the company recommends packing the items safely in order to prevent damage during the delivery process and to ensure they cannot be recognized by third parties.

The Seller must enclose confirmation of ownership when sending a parcel to Goldbuyer Joseph. This confirmation of ownership is also integrated in the general sales form.

The Seller affirms that the items sent to Goldbuyer Joseph are the Seller’s unrestricted property, which underlies the Seller’s sole power of disposal, do not originate from any criminal act and have neither been transferred nor bonded.

Furthermore, the Seller confirms that all details stated in the sales form, in particular details about full names, address, date of birth and nationality, are correct and were filled in by the Seller personally.

Price Quote

After analysing and examining the items sent by the Seller, Goldbuyer Joseph will submit a quote if interested in buying the items either by phone, e-mail, fax or by post. Should it not be possible to submit a quote, Goldbuyer Joseph will return the items sent by the Seller to the address stated in the sales form.

Freezing (Freezing the Price for Precious Metals)

In principle, every Seller is free to freeze the current precious metal price displayed by the gold calculator (pay-out amount) free of charge. KJ noble metals is obliged to pay out the respective frozen price insofar as the purity level stated when freezing the price as well as the amount of items stated correspond with the actual purity level and amount of the items sent. Freezing the price is also binding for the Seller. A gold price that has already been frozen for a certain amount to be sold cannot be frozen once again. The Seller can, however, freeze the price for any number of amounts to be sold. The requirement is that the respectively frozen amount of precious metals is actually sent to Goldbuyer Joseph within 10 days of freezing the price. If the items are not sent within these ten days, Goldbuyer Joseph is released from the obligation to pay out the frozen amount of money.

Exceptions to Freezing (Freezing the Price for Precious Metals)

The gold calculator is connected to the current live market prices of the respective commodity markets. Should an obviously inflated pay-out amount be stated due to a technical error, which is then frozen by the Seller, KJ noble metals is exempt from the obligation to purchase and to pay the frozen pay-out amount. An obviously inflated pay-out amount would be if the gold calculator displays a pay-out amount that exceeds the market price for precious metals being traded on the commodity market.

Return Delivery

Goldbuyer Joseph’s obligation to return items is restricted to the proper sending of the items by post through a recognized postal, delivery or other transport company. In the case of proper sending of the items, the risk of accidental loss or loss of or damage to the items caused by third parties is passed on to the Seller.

After receiving the return delivery, the Seller is obliged to inspect the parcel in terms of completeness (e.g. weight, amount, number of items) and to check for damage. Goldbuyer Joseph must be informed about possible complaints immediately.

If the Seller does not observe the notice period or does not fulfil the obligation of immediate inspection, the return delivery is regarded as accepted.

If the weight of the parcel that will be returned exceeded 1 kilogram, Goldbuyer Joseph charges a fee of £ 15.00 for the reshipping costs.

Returning gemstones and precious stones

The free removal and return of gemstones and precious stones shall only occur if this has been expressly stated in the "What I would like to tell you" box on the sales form. Goldbuyer Joseph cannot take any oral requests into consideration because during the process of analysis, stones of any kind are disposed of. When delivering items personally to royalgoldbuyers.co.uk, a written request to send back the stones must be enclosed in the parcel/envelope.

Analysis and Examination

The Seller allows Goldbuyer Joseph to file all items sent to examine the authenticity and purity. Such impairment to the substance of the items is necessary to such an extent that individual parts of the items have to be filed up to 7mm. The Seller irrevocably agrees to this. The same applies to damage resulting from this process. He waives possible claims for damage in this respect. In all other cases, damages can only be made up for in accordance with the following provisions.

Liability

Claims by the Seller for damage are principally excluded. Exceptions to this are claims for damage by the Seller based on injury to life, body, health or the breech of essential contractual duties (cardinal duties) as well as the liability for other damage based on intentional or grossly negligent breeches by Goldbuyer Joseph, the legal representatives or the agents of the same. Essential contractual obligations are those that need to be fulfilled to reach the objective of the contract.

Goldbuyer Joseph is only liable for foreseeable damage typical for this type of contract if it was caused negligently unless it involves a claim for damage by the Seller resulting from injury to life, body or health. However, the Seller irrevocably waives the replacement of such damage that can arise from filing. The same applies to consequential damage arising.

These restrictions also apply in favour of the legal representatives and agents of the Seller if claims are made directly to them.

Defects

The Seller will be informed immediately about any possible damage to items sent, so that the Seller can submit a corresponding claim notice to the logistics company. The Seller must make sure that the logistics company inspects the rejected delivery at Goldbuyer Joseph’s office and collects it. Should costs be incurred, the Seller declares paying for them.

Buying and Paying the Purchasing Price

When the Seller sends the items, it is a request to Goldbuyer Joseph to quote a purchasing price. After examining the items, Goldbuyer Joseph will submit an offer to the Seller if interested in buying the items. As soon as the Seller has accepted the quote from Goldbuyer Joseph, payment of the agreed amount of money will be initiated.

The Seller chooses between a bank transfer, PayPal, cheque or payment in cash to be delivered by post (cash by post: please note that for security reasons, Goldbuyer Joseph only pay out amounts of up to 1.500 pounds to one and the same seller).

Goldbuyer Joseph always guarantees to pay the client the agreed purchase price for the valuables in full.  There will be no deductions made from the agreed purchase price. Goldbuyer Joseph does not assume any liability for deductions made from the client's recipient bank during the international bank transactions and transfer process.

If the Seller is a business person in terms of §14 German Civil Code, this must be stated separately. Non-compliance to this may lead to the sales contract becoming void. After accepting the offer, the commercial Seller is obliged to send Goldbuyer Joseph a suitable invoice according to current laws. The invoice will be paid promptly after receipt.

Transfer of Title

The title to the items bought is transferred to Goldbuyer Joseph on payment of the purchase price.

Severability Clause

These General Terms of Business replace all agreements and arrangements made prior to concluding a contract and finally regulate the relationship between the parties insofar as no written amendments to a contract were made, which are declared to be part of the contract. The legal ineffectiveness of one provision does not affect the effectiveness of the other parts of the contract.
